Terms and conditions of sale

Preamble

The present General Conditions of Sale aim at defining the contractual relations between Ebony Skin Care and its Customer and the conditions applicable to the sale of goods carried out by the means of the Ebony Skin Care Internet site named www.Ebonyskincare.com (the “Products”), that the Customer is professional or consumer.

The acquisition of Products through the present website implies an acceptance without reserve by the Customer of the present General Conditions of Sale.

These General Conditions of Sale will prevail over any other general or particular conditions not expressly agreed by Ebony Skin Care.

Ebony Skin Care reserves the right to modify its General Conditions of Sale at any time. In this case, the applicable conditions will be those in force at the date of the order by the Customer.

1 – Object

This is a contract for the sale of goods, within the framework of a distance selling system.

2 – Acceptance of the offer

The system of automatic registration, provider to which Ebony Skin Care, entrusts the transaction on line, is regarded as being worth proof of the nature of the sale and its date. The Customer will receive by e-mail a confirmation of his order which will include the constituent elements. This confirmation will be considered as the date of conclusion of the subscription contract, and acceptance by the customer of the present General Terms of Sale. In case of offline order, the mail or fax of order emanating from the Customer or his representative is worth date of conclusion of the sale contract, and acceptance by the Customer of the present General Conditions of Sale.

3 – General obligations of the parties

3-A Obligations of EBONY SKIN CARE

Ebony Skin Care undertakes, after confirmation of the order, to sell and deliver the Products ordered by the Customer within the limits of available stocks.

3-B Obligations of the Customer

By placing an order, the Customer agrees to take delivery of the Products ordered by him and to pay the price and, more generally, to respect the present General Conditions of Sale. If the delivery is made, at the Customer’s request, to a third party, the Customer must ensure that the person taking delivery accepts these General Terms and Conditions of Sale. The Customer is responsible for any damage that Ebony Skin Care could undergo, directly or indirectly, because of the non-observance by himself or by the person who takes delivery of the Products of the obligations put at his charge under the present General Conditions of Sale.

4 – Characteristics of the sold goods

Ebony Skin Care proposes with the sale on Internet site www.ebonyskincare.com whole or part of its catalog produced.

The photographs illustrating, with the support of the text, the Products, do not enter the contractual field. If errors were introduced there, in no case the responsibility for Ebony Skin Care could not be committed. There may indeed be a difference between the photographic rendering of the Products sold and reality.

5 – Prices

On the Internet site www.ebonyskincare.com, the prices are expressed in euros including all taxes. The amount of VAT is calculated at the rate in force on the day of the order.

The modification of the planned order may give rise either to the delivery of a credit note if the price of the new Products ordered is lower than the price of the Products initially provided for in the contract or to the payment of a price supplement if the price of the new Products ordered is higher than the price of the Products initially provided for in the contract.

6 – Validity of the offer

All orders will be honored within the limits of available stocks. In case of stock shortage, will deliver the Customer upon receipt of the product sent by the supplier, however in the event that its supplier would be unable to provide the Product ordered by the Customer, Ebony Skin Care reserves the right to substitute a Product of equivalent quality to that provided in the initial order.

7 – Delivery

The deliveries proposed by Ebony Skin Care can be carried out on the territory of Metropolitan France and the international.

The choice of the mode of routing and delivery of the Products falls to Ebony Skin Care. As from the deposit of the parcel at the Post office, which takes place 2 times per week, Monday and Thursday, the delivery is 48 hours

The participation in the expenses of packing, handling and sending is subject to modification and constant improvement. Ebony Skin Care takes in charge a part of the expenses of packing, handling and sending and proposes you a single tariff of delivery (France only except DOM TOM) of 15 euros if the order of the Customer is lower than the sum of 100. Beyond that amount, the Customer is exempt from shipping costs.

The delivery is made to the address indicated by the Customer, in case of absence a notice is given to him to agree on a second visit. If the Customer is absent again, the parcel must be collected by the Customer from the post office mentioned on the delivery notice. Transport is at the Customer’s risk and the Customer must check the packages on arrival and if possible in the presence of the carrier. In the event of shortage or damage, the Customer must make a visual inspection or express any reservations to the carrier in writing within three days of receipt.
